Pakistani laws prohibiting underage marriage un-Islamic: CII




ISLAMABAD: The Council of Islamic Ideology (CII) concluded its 191th meeting, here Tuesday with the ruling that the laws related to minimum age of marriage were un-Islamic and that children of any age could get married if they attain puberty.
At the conclusion of two day meeting, Chairman CII Maulana Muhammad Khan Sheerani noted that the laws related to marriage too were unfair and there cannot be any age of marriage.
However, he explained that there were two segments of marriage – nikah and ruksati, while nikah could be performed at any age.
“Even the minors can have nikah but that has to be executed by the guardians,” chairman CII said adding, “But ruksti could be executed only after attaining the age of puberty.”
He said that the age of puberty varies from individuals to individuals and it was the responsibility of guardians to have ruksati soon the child attains the age of puberty.
“The laws limiting the age for both the segments of marriage are unIslamic and needed to be rectified,” he added.
Officials told Dawn that the council members discussed various historic references related to marriage and concluded that each girl has different age of reaching puberty.
The officials were asked if the international conventions signed by Pakistan related to child marriage would be violated after this ruling by CII.
Responding to the query the official said that the international conventions cannot be in contradiction to the constitution of the country or Islam and if they were, those particular clauses would not apply on Pakistan.
The CII meeting also suggested to the government that ‘nikah’ registrars should have a certain level of qualification.
“Not everyone should be allowed to become a Nikah Registrar,” Maulana Sheerani demanded the government, “While the fee for registration of Nikahnama should also be abolished.”
The CII had on earlier day suggested the government to change Muslim marriage laws as it required Muslim male to seek permission from the previous wife or wives for another marriage.
Meanwhile, the Pakistan Peoples Party’s (PPP) human rights cell has expressed concern over the CII rulings.
“Why is Council concerned with men’s four marriages and why have they done nothing to ensure that women get their property as enshrined in Islamic Law? Or why have they failed to stop practices such as vani, swara and karo kari? Or stop rape, and acid crimes against women?” asked Dr Nafisa Shah, coordinator PPP’s human rights cell.
“Unfortunately Islam has been misinterpreted over a period of time by a mindset and a particular school of thought. Islam and modernism are compatible provided progressive scholars interpret the religion,” she added.
The PPP human rights cell has called upon the government to include progressive Islamic scholars in the council so that women’s rights and the rights of all are protected.

Grand Mufti urges Muslims to forge unity, shun evil deeds

MOUNT ARAFAT, Saudi Arabia: Mufti Azam Saudi Arabia, Sheikh Abdul Aziz Bin Abdullah delivered Hajj sermons in Masjid-e-Nimra at Mount Arafat, urging Muslims to shun evil, forge unity and staunchly practice teachings of Islam, SAMAA reported.

“Islam is a complete code of life, it’s a perfect and definite religion of Allah, it teaches brotherhood among Muslims and provides spiritual, moral and social training,” said the grand Mufti while addressing millions of Hajj pilgrims.

The chief mufti urged Muslims to keep away from crimes, such as murder and other evil deeds.

“The murder is great fitna (mischief) in Islam. Our religion teaches the abidance of Allah and His Prophet… Islam prohibits obscenity as haram and sin… Oh Muslims! Be God-fearing, keep a control on yourselves,” he said.

Mufti Azam Pakistan blasts ‘Zaliman’ attackers over Peshawar school carnage


ISLAMABAD: Top Islamic cleric of Pakistan, Mufti Azam Pakistan Maulana Rafi Usmani termed the attackers of Peshawar’s Army Public School as ‘Zaliman (tyrants)’ but not ‘Taliban (Students of Islam).
Mufti Rafi Usmani slammed the attackers’ self-adopted ideology of Islam, said that targeting women and children, even if they were non-Muslims, was not accorded in Islamic principles.
He expressed his suspicions that some hidden hands were accomplishing their ulterior tasks with hands of terrorists continuously targeting Muslims.
True ‘Taliban (student)’ and educated Islamic clerics cannot follow such self-adopted ideologies that could allow attacks on innocents citizens, Usmani added. Innocent children martyred brutally by the terrorists and such wildness cannot be tolerated in Pakistan, he said.
He prayed, ‘Allah Almight! Give us rid of terrorists.’ He appealed Pakistani nation, political and religious leadership to be united under one flag to help uprooting terrorism from the country.

Dr Khalid Mehmood Soomro — a profile

LARKANA: Dr Khalid Mehmood Soomro was born on May 7, 1959 to a religious family in the picturesque Akil village surrounded by thick guava orchards close to the Indus river near Larkana. 

The village has produced many prominent personalities including chief minister the late Ayoub Khuhro, Dr Hamida Khuhro, Nisar Ahmad Khuhro and famous Sindhi poet Zaib Aakli.

Dr Soomro shot to prominence after he became a central leader of the Sindh chapter of the Jamiat Ulema-i-Islam-Fazl. His courage, grit and unwavering allegiance to Sindh’s rights earned him equal respect among friends and foes.

After the death of his father Maulana Ali Mohammad Haqqani, Dr Soomro took up his mantle and took charge of Ishaatul Quran madressah founded by his father. He remained its head till his killing in Sukkur during Fajr prayers on Saturday.

Dr Soomro was a highly learned scholar who proved his mettle in all curricular and extracurricular activities throughout his academic career, starting with his joining Shah Latif Scouts Open Group and his participation in declamation contests in 1972-73 when he was doing matric at the Government Pilot Secondary School, Larkana.

After having done his intermediate at the Government Degree College where he organised the Jamiat Tulaba-i-Islam (JTI), student wing of the JUI-F, he joined the Chandka Medical College in 1976 and became joint secretary of the college’s students union.

During his stay at the CMC he not only organised the JTI but also actively participated in elections for student unions.

Despite being a staunch follower of a particular religious school, Dr Soomro was equally loved and respected by his friends and foes. After his graduation in 1983 he chose to do the house job in paeds-medicine and surgery.

He also did masters in Islamic culture from Sachal Sarmast Oriental College, Larkana, and completed his religious studies from the International Islamic University, Islamabad, with distinction.

Iqbal Soomro, younger brother of Dr Soomro, said that his brother was admitted to Al-Azhar University, Egypt, where he had the honour of being a student of Prof Jadul Haq Jad, the then vice chancellor of the university. After learning extensively from different institutions, he decided to share his father’s responsibilities who had by then grown very old.

He joined practical politics in 1988 and remained secretary general of the JUI-F Sindh chapter till 2014.

Dr Soomro actively participated in the Movement for the Restoration of Democracy in 1983 which landed him in Sukkur jail and he remained behind bars for nine months.

Dr Soomro was in the forefront of a protest when a military court set up at the Sir Shahnawaz Library was trying his spiritual guide Maulana Abdul Karim of Bair Sharif near Qambar town for a fatwa he had issued against Gen Ziaul Haq.

Dr Soomro came in the limelight when he contested polls against former prime minister Benazir Bhutto for NA-207. He fought for the same seat against Faryal Talpur also.
He remained member of the Senate from 2006 to 2012 where he always spoke for the rights of Sindh. He was very vocal against the division of Sindh.

This was the seventh murderous attack on Dr Soomro which proved fatal. He leaves a widow, six sons and three daughters.

Maulana Fazal-ur-Rehman Profile

Born on June 19, 1953 in Abdul Khel, D.I Khan, Maulana Fazal-ur-Rehman was elected as MNA for his third term on an MMAP seat. He is the President (Ameer) of JUI(F). He is also Secretary General of MMAP.


After completing an M.A. in Religious Studies, he pursued a teaching career and is currently Principal of Jamia-al-Maroof Sharia. During his previous term as MNA, Maulana Fazal-ur-Rehman has served as Chairman Foreign Affairs Committee of the National Assembly.
Married and father of three sons and three daughters, he has travelled to several countries within Asia, Europe and Africa.

Of firsts: Shia delegation attends Tablighi Ijtima


GILGIT: Shia cleric Agha Rahat Hussaini and 200 adherents set an unforeseen precedent for religious tolerance as they attended a Deobandi scholar’s lecture in a Sunni congregation.

The Tablighi Ijtima, which started on June 9 in Gilgit, is attended by hundreds of thousands from across the country and is held under the banner of the Tablighi Jamaat, a Sunni organisation. The sermon was delivered by Deobandi preacher Maulana Tariq Jamil.

Junaid Jamshed booked for blasphemy

KARACHI: A blasphemy case was registered on Tues­day against singer-turned-preacher Junaid Jamshed on the directives of a district and sessions court for one of his televised sermons that is thought to contain blasphemous remarks about a wife of Prophet Muhammad (peace be upon him).

SSP-City Sheeraz Nazeer said the case had been registered on a complaint of a leader of the Sunni Tehreek at the Risala police station under Sections 295-C (use of derogatory remarks in respect of the Holy Prophet) and 298-A (use of derogatory remarks etc in respect of Holy Personage) of the Pakistan Penal Code.

The SSP said that Mr Jamshed had not yet been arrested. He said that the matter would be investigated by a senior officer before taking any action.

ST leader Mobin Qadri moved an application in the court under Section 22-A of the criminal procedure code seeking registration of a blasphemy case against Mr Jamshed for allegedly making blasphemous remarks about the Holy Prophet and his wife Hazrat Ayesha (RA).

He said the programme had been aired by a private television channel and was also uploaded on various social media websites. He added that he had approached the police station concerned, but the officials refused to entertain his application for the registration of a case.

Disposing of the application, District and Sessions Judge (south) Ahmed Saba directed the Risala SHO on Tuesday to record the statement of the applicant under Section 154 of the CrPC and register a case accordingly if a cognisable offence was made out.

Meanwhile, Mr Jamshed released a video message on Tuesday in which he apologised for his remarks and asked for forgiveness.
